Prosecutors have asked that Kirkham stays in the Salt Lake County Jail until the conclusion of his criminal prosecution because of his violent past.

Joann Kirkham, 72, was killed in Kearns, New Jersey, in 2005 after being beaten with a rock and made to inhale paint fumes from a bag.

Although he was first accused of murder, he eventually entered a “guilty and insane” plea to the lesser charge of manslaughter.

His probation was revoked in 2009, and he was ordered to complete his initial one to a 15-year term at the Utah State Prison, according to court documents. He had previously been sentenced to the Utah State Hospital and a halfway home.
